Your legal options for trusted access in Scotland

Continuing / Combined Power of Attorney (POA): This is a legal document that lets an Attorney handle your financial affairs in Scotland. It can be set up to start immediately or only if you lose mental capacity.

How to apply: A POA can be drafted by you or a solicitor. You’ll need to register the POA with the Office of the Public Guardian (Scotland) for it to become valid.


Guardianship Order: This is a court order that gives a person (the Guardian) the legal authority to manage your money, property, and financial affairs long-term.

How to apply: You’ll need to apply through the Sheriff Court with the help of a solicitor and then register the order with the Office of the Public Guardian (Scotland).
