Your legal options for trusted access in England and Wales

Lasting Power of Attorney (LPA): A long-term legal document that stays valid even if you lose mental capacity.

How to apply: You can make an LPA online. You’ll need to register it with the Office of the Public Guardian (OPG), then get in touch with us to link it to your account.


Enduring Power of Attorney (EPA): These are older documents signed before October 2007. They work similarly to an LPA, and we can still accept them as long as they’re correctly registered.

How to apply: If an EPA wasn’t created before October 2007, you must apply for a Lasting Power of Attorney (LPA) or Deputyship. You can register an EPA on the government’s website once the donor starts to lose mental capacity.


Deputyship Court Order (England and Wales): If someone can’t make decisions for themselves and doesn't have an LPA, the Court of Protection can appoint a Deputy to step in.

How to apply: You can apply to be a Deputy or via post. The Court of Protection will review your application and issue a sealed Court Order once approved.


General / Ordinary Power of Attorney (GPOA / OPOA): A simple way to get help while you still have mental capacity. You can set specific limits, depending on what you want your attorney to do, and even set an expiry date.

How to apply: These can be prepared by you or a solicitor. For it to be valid, it must have the specific, legal wording and be witnessed correctly.


DWP Appointeeships: This is a specific setup where the Department for Work and Pensions (DWP) authorises someone to manage your benefit payments for you.
